According to the former Municipal Manager Matlakala Irene Mathews testified this week that she approved and signed a document for an amount of R10-million to Ndwandwe on 8 August 2014.
The sponsorship was for Ndwandwe’s show The Big Break Legacy that was aired on SABC.
It is said that he wanted to film his third season of The Big Break Legacy.
This was just after a local entrepreneur, Sanele Makinane won the show in 2013 and walked away with R5-million investment into his business.
During the trial that star-ted on Monday 16 March, Ndwandwe’s legal representative was grilling SABC’s Credit Manager Alistair Louw as well as other sponsors which included municipal officials like former MM Mathews, Lebogang Kalolo and others.
It was also said in court that Ndwandwe is not denying the payment to him, but there was not a letter of commitment from the municipality.
But ex-MM Mathews said during the agreement with Ndwandwe about the initiative, she signed a memorandum of understanding as well as a letter of commitment which she read in court and was handed in as evidence.
Kalolo told the court that he was once in a meeting as an observer in June 2015 with some of his colleagues together with Ndwandwe.
At that time, he decided to do a cellphone recording which is now in possession of the court after he realized that there was no one taking minutes of the meeting.
An argument was raised by the accused’s legal representative that it was unfair to do that recording without informing anyone in the meeting.
In that meeting, it was about the expenditure done for Ndwandwe’s project as there was no work done.
Mayor Barei Sekgotso-Mosiane said Ndwandwe was given money for the project, but he didn’t do the job, so the municipality demanded its money back and he failed to pay it back, so that’s why he’s in court.
At the time of going to press, Mathews was still on the witness stand.
Lentswe learned that the SABC then also approached the South Gauteng High Court in Johannesburg after Ndwandwe failed to pay them back, but the high court issued a written order for the sheriff to attach his assets and his company assets to recover the unpaid debts.
